(Adds background) TOKYO, Jan 16 (Reuters) - Sumitomo Metal Mining Co Ltd(5713.T) said on Friday that 2009 copper processing fees had beensettled at $75 a tonne and 7.5 cents a pound with both BHPBilliton Plc/Ltd (BHP.AX)(BLT.L) and Freeport-McMoran Copper &Gold (FCX.N). A company spokesman at Japan's second-largest copper smeltersaid the price participation clause had not been resurrected ineither of the contracts for 2009. Japan's top copper smelter Pan Pacific Copper Co Ltd andMitsubishi Materials Corp (5711.T) this week also agreedprocessing fees with BHP. ID:nT226070 Both companies declined to provide details other than to saythat treatment and refining charges (TC/RCs) for 2009 were upabout 70 percent from the previous year. For the past few years, Japanese smelters have been forced toaccept low processing fees from global miners due to tightsupplies of concentrate, which increased the competition for theraw material among smelters. The steep slump in global demand for the metal, which has awide range of applications from electronics to the power sector, has led to an increase in concentrate supplies.

The virtual absence of demand has also forced Japanesesmelters to reduce production, and industry analysts say sharplyimproved processing fees will not provide a panacea for theJapanese copper industry. "Demand has just nosedived, and better TC/RC terms won't beable to change the situation," one industry analyst said onFriday. BHP and large Chinese copper smelters are expected to settleterm TC/RCs for 2009 soon at $75 and 7.5 cents, smelter sourcessaid on Friday. ID:nHKG187135 Japanese smelters will also be smarting over their failure tobring back the price participation clause, which helps boostprocessing charges when copper prices rise. Smelters usually have two types of annual contracts withminers for the fee to turn copper's raw material, concentrate, into metal, which are a major source of income for smelters The contracts begin either in January or July (Reporting by Miho Yoshikawa; Editing by Michael Watson).
